Terms of Service

1. Acceptance of Terms

By accessing and using VideoBuffer ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

VideoBuffer provides a cloud-based platform that enables users to record RTSP camera streams with configurable rolling buffer retention. The Service includes:

• RTSP stream ingestion and recording
• Rolling buffer storage with configurable retention (24 hours to 30 days)
• Live viewing and time-shift playback
• Web-based DVR player with timeline scrubbing
• Clip export functionality (MP4)
• Multi-camera support (depending on plan)
• Embeddable player widgets

3. User Accounts

To use VideoBuffer, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Acceptable Use

You agree NOT to use the Service to:

• Record or store illegal, harmful, or inappropriate content
• Violate privacy laws or record individuals without proper consent
• Infringe on intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems or other users' content
• Use the Service for any unlawful purpose
• Record content in violation of surveillance or wiretapping laws
• Resell or redistribute the Service without authorization
• Exceed usage limits or attempt to bypass storage quotas

5. Subscription and Billing

5.1 Subscription Plans

VideoBuffer offers various subscription plans with different buffer retention periods, storage limits, and features. All fees are charged in advance on a monthly or annual basis.

5.2 Free Trial

We may offer a free trial period. You will not be charged until the trial period ends. You can cancel at any time during the trial without being charged.

5.3 Automatic Renewal

Subscriptions automatically renew unless canceled before the renewal date. You will be charged at the then-current rate for your plan.

5.4 Storage and Bandwidth

Each plan includes a specific amount of storage for your rolling buffer. If you exceed your plan's storage limits, you may be required to upgrade to a higher plan or reduce your buffer retention period.

5.5 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. All recordings will be permanently deleted after your subscription ends. No refunds will be provided for partial months.

5.6 Price Changes

We reserve the right to modify our pricing. We will provide at least 30 days' notice of any price changes affecting your subscription.

6. Content Ownership and Rights

6.1 Your Content

You retain all rights to the video content you record through VideoBuffer. You are solely responsible for ensuring you have the necessary rights, permissions, and legal authority to record and store such content.

6.2 Limited License

By using the Service, you grant VideoBuffer a limited license to process, transmit, store, and display your content solely for the purpose of providing the recording and playback service.

6.3 Content Deletion

Recordings are automatically deleted when they exceed your configured retention period. We are not responsible for the loss of recordings that exceed the retention period or are deleted upon account cancellation.

7. Service Availability

We strive to provide 99.9% uptime, but we do not guarantee uninterrupted or error-free service. The Service may be subject to:

• Scheduled maintenance (with advance notice when possible)
• Temporary interruptions due to technical issues
• Recording gaps due to network connectivity issues
• Service limitations or degradation during peak usage
• Modifications or discontinuation of features

8. Data Loss and Backup

While we implement redundancy and backup systems, we are not responsible for data loss due to:

• Service outages or technical failures
• Automatic deletion at the end of retention periods
• Account cancellation or termination
• User error or accidental deletion

It is your responsibility to export important clips before they expire from your rolling buffer.

9. Termination

We reserve the right to suspend or terminate your access to the Service:

• For violation of these Terms
• For fraudulent or illegal activity
• For non-payment of fees
• For recording content that violates laws or regulations
• At our discretion, with or without cause

Upon termination, your right to use the Service will immediately cease, and we will delete all your recordings and data within 48 hours.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• CONTINUOUS RECORDING WITHOUT GAPS
• RETENTION OF RECORDINGS BEYOND CONFIGURED PERIODS

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEOBUFFER SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, recordings, or business opportunities
• Service interruptions, recording gaps, or data loss
• Failure to record critical events
• Unauthorized access to your recordings
• Legal consequences arising from your use of recordings

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold VideoBuffer harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights or privacy laws
• Content you record through the Service
• Unauthorized or illegal recording activities

13. Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VideoBuffer operates, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits.
